Criminal charge against coffee shop owner suspended

According to the decision, the law does not require separate license for the business registered by Mr. Tan as per Article 159 of the Penal Code and food hygiene and safety certificate is optional in this sector.
 
Decision to accuse him of conducting illegal business and prosecute after two inspections in his shop issued by district police was wrong.
 
Therefore, leader of the Binh Chanh district People’s Procuracy made the decision to suspend the criminal case and restore legal rights for Mr. Nguyen Van Tan.
 
The decision was made after a mission led by head of the Supreme People’s Procuracy Le Minh Tri worked with the People’s Procuracy in HCMC and Binh Chanh district on April 23.
 
After listening to reports on the case, Mr. Tri instructed the HCMC Procuracy to suspend the legal proceedings against Mr. Tan, publicly apologize him and compensate any damage (if have).
 
He also asked leaders of the HCMC People’s Procuracy to suspend the prosecution and apply disciplinary measures against those who conducted the lawsuit against the shop owner.
 
Talking to the media on April 24, director of the HCMC Police Department Lt. Gen Le Dong Phong said that they would make clear responsibilities of Binh Chanh Police leader Colonel Nguyen Van Quy, who signed the decision to prosecute Mr. Nguyen Van Tan.

 
Afterwards the city police will propose suitable disciplinary measure against the colonel to the General Department of the People’s Police. Other Binh Chanh police officials related to the case will be strictly handled, he said.
 
In related case, a man building a hut to tend his ducks on his land has been prosecuted for breaking house management regulations in Binh Chanh, which Sai Gon Giai Phong Newspaper reported on April 23.
 
Mr. Le Dong Phong said that he had instructed the Investigation Agency under the city Police Department to clarify this information. If the agency spots any wrongdoing by the Binh Chanh Police, the city Police will strictly handle them, he affirmed.
